This agreement (hereinafter referred to as the "Offer", "Agreement") regarding the terms of making payments in the form of charitable contributions to the account of the Charitable Foundation "Peace for the Future" is public in accordance with Art. 641, 644 of the Civil Code of Ukraine and its terms and conditions are the same for all users of the site of CF "Peace for the Future" (hereinafter referred to as the "Site").
Before starting a money transfer, in the form of a charitable contribution, you must read the terms of this Offer.
1.1. The parties to this Offer are CF "Peace for the Future" (EDRPOU code 44745090) (hereinafter referred to as the "Fund") and an individual or legal entity (hereinafter referred to as the "person" "User", "Site User") who accepted (confirmed) this Offer by clicking the "I agree with the terms of the public offer" button before crediting the corresponding charitable contribution (donation).
1.2 . Payment on the site is made either by card using the https://fondy.ua/ service (ELIENS LLC) through such electronic means of payment as: Apple pay/ Google Pay, as well as VISA / Mastercard or to the current account of the Fund according to the specified details.
1.3. You can make at your discretion and at your own request any amount of money as a charitable contribution of at least 1 UAH (or in the appropriate equivalent in US dollars, EUR and other currency).
1.4. When making a transfer, the purpose of payment must be indicated: either, in accordance with the target fee of the Fund at the choice of the Person making the transfer, or with the designation "for the statutory purposes of the Fund".
1.5 . If the purpose of payment was not specified, the Fund independently decides the purpose of directing the transferred funds, in accordance with its statutory activities and in compliance with the current legislation of Ukraine.
1.6 . If at the time of transfer of the charitable contribution with the intended purpose of the corresponding fundraising by the Fund it is established that this fee is closed due to the achievement or non-achievement of its goal, in this case the Fund independently decides the purpose of directing the transferred funds, in accordance with its statutory activities and observing the requirements of the current legislation of Ukraine.
1.7 . The amount of money is considered to be transferred at the time of crediting funds to the bank account(s) of the Fund.
1.8 . The transfer of funds (charitable contribution) is also additionally regulated by the rules of the payment service, the bank, including the bank issuing the card of the person transferring funds to the Fund and other participants in such payments.
1.9 . The Fund does not process transactions on bank cards. In case of errors or refusals in the transfer, the person must contact the bank of the card issuer or a representative of the payment system through which the payment was made.
1.10 . The user of the site is solely responsible for providing erroneous or false information during the transfer of funds.
1.11 . Any money transfer made on behalf of the Site User using personal data and payment means of such User is considered to be made by the User himself.
1.12 . Money transfer does not include a commission and additional fees of banks and payment systems. The buyer independently and at his own expense pays such fees. The amount of the commission or additional fee is reported by the relevant bank and payment system. The user of the site independently and at his own expense pays such commissions and fees (if any).
2.1 . All disputes arising from the performance of this Offer regarding the termination, modification, invalidation in whole or in part, or in connection with it, or arising from it, are resolved through negotiations, and if it is impossible to resolve – such a dispute is subject to judicial review, in accordance with the current legislation of Ukraine.
3.1 This Agreement shall enter into force on August 1, 2022 and shall remain in force, except for any changes in its provisions in the future, which will come into force immediately upon publication on this page.
3.2 We reserve the right to update or change our Agreement at any time and you should check this Agreement periodically. Your continued use of the Site after we post any changes to the Agreement on this page will constitute your recognition of the changes and your agreement to comply with the amended Agreement.
